President-elect Donald Trump was busy this week making cabinet picks and shaping his DOJ before his new term in the White House. On Wednesday, Trump picked firebrand Republican Congressman Matt Gaetz to be his nominee for attorney general, selecting an ally who has faced DOJ scrutiny to run the agency.
Yesterday, Trump picked three members of his criminal defense team to serve in senior roles at the department, including lead attorney Todd Blanche as deputy AG. Trump also selected John Sauer, who successfully urged the U.S. Supreme Court to give Trump broad immunity in the 2020 election case, as his solicitor general. Emil Bove was picked to serve as Blanche's top deputy and acting deputy attorney general while Blanche awaits confirmation.
Trump's return to office is expected to precipitate a shift in the U.S. government's legal stance in major cases pending at the Supreme Court, including a closely watched dispute involving Tennessee's ban on gender-affirming medical care for transgender minors. On Monday, a Trump transition team official warned existing DOJ staff against "resistance" to Trump's agenda.
In other picks, Trump named former SEC Chair Jay Clayton to serve as Manhattan's top federal prosecutor. That office is poised to devote fewer resources to policing cryptocurrency crimes, a senior prosecutor said on Friday.
